Terms and Conditions

Article 1. Applicability

1.1. These general terms and conditions apply to all our offers and to all agreements related to the activities of Frank Middendorp or any of the brand names/legal entities under which these activities fall under B.V. Chamber of Commerce 58200622 [hereinafter referred to as ‘the organization’].

1.2. Where these general terms and conditions refer to ‘participant’ or ‘Coachee’, it also means any natural or legal person who is in a contractual relationship with the organization based on an agreement with the organization or wishes to enter into another type of agreement.

1.3. Any deviations from these general terms and conditions can only be agreed upon in writing.

1.4. Where these terms and conditions refer to ‘trainings’ or ‘programs’, it also means the provision of services and activities of any kind.

1.5. Where the terms refer to ‘registration form’, it also means registration via email, one of our websites, or a verbal agreement. It is the customer’s responsibility to request written confirmation in the case of a verbal agreement.

1.6. Only Dutch law applies to the agreements entered into by the organization.

1.7. The participant also agrees to all additional program-specific conditions as will be clearly described on the respective registration forms and/or product descriptions on invoices, etc.

  • a) The participant has participated in the entire program, missed no sessions (including any follow-up evenings), and completed all homework assignments.
  • b) The participant must send a motivated email to office@gurdjieff-ouspensky-foundation.org no later than 1 week after the last session.

1.8. These general terms and conditions are subject to change and will be continuously updated on the website https://www.gurdjieff-ouspensky-foundation.org

1.9. By registering and/or participating in one of our events or programs (offline or online), a participant agrees, either explicitly or implicitly, to these general terms and conditions.

Article 2. Registrations

2.1. A registration for training or a course is established by signing the respective registration form, registering via one of our websites, or making a verbal agreement.

2.2. The participant is responsible for the accuracy and completeness of the information provided on the registration form.

2.3. A registration is strictly personal and can only be transferred with the written consent of the organization. A request for substitution can only be made by email via office@gurdjieff-ouspensky-foundation.org

Article 3. Payment, Changes, and Cancellations

3.1. The participant agrees to the payment terms as described behind the option they have selected on the registration form.

3.2. All training and events are exclusive of catering and/or accommodations unless explicitly communicated otherwise in writing.

3.3. To cancel or change a training, the participant must send an email to office@gurdjieff-ouspensky-foundation.org with an explicit request for confirmation.

3.4. The following costs may be associated with canceling participation in training or an event.

3.5. The following costs may be associated with changing the date of participation in training or an event.

Article 4. Well-being

4.1. The training and programs are intended for physically and mentally healthy individuals and are in no way a replacement for professional medical or psychological assistance.

4.2. The participant declares that they have sufficiently informed themselves about the nature and content of the programs and considers themselves mentally and emotionally capable of handling a program based heavily on self-reflection.

4.3. By participating, the participant implicitly agrees to be fully responsible for their own mental and physical well-being during and after the training.

4.4. The participant acknowledges and agrees that the trainers of the organization do not have a medical background and are only trained to lead the program.

4.5. In case of doubt about someone’s ability to participate, the management may request a doctor’s certificate.

Article 5. Disposition

5.1. The participant agrees to the following rules for participating in a training, presentation, or online coaching session.

5.2. The participant agrees to be coachable and constructive in the program and all interactions with the organization, both within and outside the program.

5.3. Being coachable explicitly means that the participant is willing to:

  • Consider viewpoints other than their own [open mind].
  • Be constructive in the conversation.
  • Refrain from expressing complaints during the session.
  • Address specific complaints outside the coaching conversation.

5.6. The participant undertakes to maintain confidentiality regarding what they have heard in the training from what other participants have shared in the context of the training.

5.7. The organization reserves the right to make interim adjustments and changes to the program of its products without any explicit obligation to communicate these adjustments to its participants.

5.8. However, the organization will endeavor to communicate interim adjustments and changes to the program of its products as soon as possible verbally, via the website, Facebook, or by email.

Article 6. Refunds

6.1. Refund requests must be made solely by email via office@gurdjieff-ouspensky-foundation.org

6.3. There is no refund and/or offset of already paid or still to be paid training fees possible if the participant:

  • Leaves a training or online session on their own initiative prematurely.
  • Has to leave a training or online session early based on point 5.4.
  • Cancels a follow-up training or follow-up online session that is part of a package.
  • It is excluded from participating in a follow-up training that is part of a package based on the conditions set out in Article 5.

Article 7. Audio and Video Waiver

7.1. By participating in a program from one of the aforementioned organizations, the participant agrees that the entire program or parts of it can be recorded on video, audio, and/or digital photography for training, marketing, and/or promotional purposes.

7.2. Recordings made available to participants for training purposes are strictly intended as learning materials for personal use and may under no circumstances – without the explicit written consent of the organization in advance – be made public, resold, or used for any other purpose.

7.3. The participant can trust that the organization will handle privacy-sensitive material in which the participant speaks with respect and will ask for permission for publication in advance if the participant appears in compromising statements.

7.4. In case of doubt about whether it is appropriate to make such material public, a participant can object, or the organization will first consult the respective participant.

7.5. The participant agrees that all exclusive rights to these recordings lie with the organization, and the participant expects and will not request compensation for the use of the material in which the participant appears or speaks.

7.6. Participants are not allowed, under any circumstances, to film, record video, and/or audio during the seminar.

7.7. Participants who violate this condition will be asked to erase the material, stop further use of the recording device (such as a
